Your rights

You may request a copy of your health record, correction of information, confidential communications, limits on some uses and disclosures, a list of certain disclosures, and a paper copy of this notice. You may choose a person to act for you if legally authorized. We will explain any lawful basis for denying a request. If you pay in full out of pocket for a service, you may ask us not to disclose that service to your health plan for payment or operations, subject to applicable exceptions.

Your choices

You may tell us your preferences about sharing with family, friends, or others involved in your care. We generally need your written authorization for marketing uses, sale of information, and most uses of psychotherapy notes as HIPAA defines them. You may revoke an authorization in writing for future disclosures, subject to actions already taken in reliance on it.

Our uses and disclosures

We may use or disclose information for treatment, to bill and collect payment, and to run our practice. We may also disclose information when law requires or permits it, including public health and safety needs, suspected abuse or neglect reporting, health oversight, workers compensation, law enforcement under applicable conditions, and responses to lawful court or administrative process.

Special protections may apply to substance use disorder records subject to 42 CFR Part 2. We will follow those protections when applicable. Such records cannot be used or disclosed in civil, criminal, administrative, or legislative proceedings against you without your written consent or a court order and a subpoena, as required by applicable law.

We will not use or disclose records to investigate or impose liability solely for seeking, providing, or facilitating lawful reproductive health care where federal privacy rules prohibit that use.

Our responsibilities and complaints

We must protect the privacy and security of your information, provide this notice if HIPAA applies, and notify you after a breach of unsecured protected health information when required. We will follow the notice in effect and make updated notices available.

You may complain to the privacy contact above or to the U.S. Department of Health and Human Services Office for Civil Rights. ELIS will not retaliate for a complaint. HHS complaint information ↗.
